It's used and has a some scratches on the corners, replacement covers/cases are cheap to find on eBay(If so desired I could even replace it for you). Phone works 100%, though the speaker(for speaker phone and ringtones) does have a noticeable vibration when on loud. I just flashed the phone with Cyberwulf's MP(from the modmymoto forums, which is down so I can't give specifics yet), which from memory includes; Opera Mini, Google Earth, File Changer, and more(I will update when/if modmymoto.com comes back online). It includes OEM battery, plus aftermarket battery, USB cable, AC charger, Owners Manual, original box, belt holster, and 128mb MicroSD with SD adapter.
