How will this stand in court?

OMFG!!!!Let me see about this.....this lady must be mental or something if she thinks that she can win this one. Animals have more sense this lady. I bet she was trying to hop the train and missed the railing :) Now she wants the company to pay for making it hard to catch the train! The person i feel sorry for is the lawyer that's representing her. Every lawyer in the country is going to be laughing at this guy.
Well this goes to show stupid some people are, I mean you see train tracks obviously a train will use them at some point unless it says "abandoned tracks" You can even hear a train coming which gives someone lots of time to get out of the way. I believe this woman was looking for a way to make easy money and thought "I know I'll walk along the tracks and get hit by a train and come up with a bs story and sue, and cha ching money for me." Good Grief

It's people like this that cause other people to hate people so they kill people.

well said
sigh......... wow...... i should sue them for sueing the other person..... aka being a stupid smacktard...... wow...-G
Wow! You can get money from sueing places for being hit by a train these days!? Where do I sign up!?!
That isn't the worst of them, but those are the people I dispise. There has been a case where someone orders an ice cream from a restaurant, then got dumped by their boyfriend, and threw the ice cream at him. She then proceeded to run out of the restaurant, slipped on the spilled ice cream, and sustained minor injuries. She then sues.
It all depends on several things. If it's a town she's lived in all of her life, she should know what train tracks are being used, and should steer clear of them. theres many train tracks in this area - and the rail road companies have repeatedly assured us (the public) that they're no longer in use, and will never be used. However, they're still connected to 'major' train stations, and the possibility of them (still) being used is still great. If i were to get injured on one of these tracks, which "are no longer in use" - I'd sue in a heartbeat. It's not my fault that they mislead me and the rest of the public. However, it seems to me that this lady has lived most of her life in this town; knowing these rail roads. Many railroads you know exactly when they're coming - easily within 30 minutes every day. At least, 'round here you do know things like that.
haha. i bet they start putting warnings on tracks b/c of this. its like warning lables on matches that say "warning: flamable". lol. She should be slapped in that court room.
hm.... i thought the railroad tracks....... the big flashing lights........... the arm things that come down... BOTH of them..... the constant LOUD dinging....... not to mention the fact A TRAIN IS VISIBLE>....... and the train honking....... was warning enough..... if you get hit by a train...................... WOW-G
I hope she gets laughed out of the court by the judge. Honestly, that lawsuit is so frivolous it's worse than the lady that spilled coffee on herself. _Hayabusa
didn't that lady win though. hey its more like the time when that bug commercial came on. a roach ran across the tv screen and some lady threw something at the tv and broke it. then she sued.
its amazing what people can get away with these days. mcdonalds got sued some time ago because an idiot lady drank some hot coffee and burned her mouth. Was she thinking she had cold coffee or something? I'm going to park my car on the railroad tracks, wait for a train to hit it, then sue the train company for not warning people that a train is coming  sad thing is that i would probably win too :lol:some people just shouldn't be allowed to walk this earch without assistance. When ever someone asks me how stupid people can get, i tell them to look in the newspaper.

maybe comman sense should be an option the defence could use against the plantiff.
Wouldn't work, these people don't have any common sense. they won't be sueing in the first place if they did :D
